These Terms & Conditions (“Terms”):
- apply to the website (URL: platform09.ae), its associated subdomains and any account you register on the website / its subdomains (collectively and individually, our “Services”) owned by [Zero Nine – Platform 09] (“Platform 09,” “we,” “our,” or “us”);
- apply to all persons that access, use or engage with our Services and apply to all emails and other communications between us and you pertaining to the Services; and are a legally binding contract between you and Platform 09.
Please read these Terms carefully to understand both our respective rights and obligations. If there is something you do not understand in these Terms or if you have further questions or comments please contact us via the details set out below. Your access to, use of or engagement with our Services is conditional upon your acceptance of and compliance with these Terms. If you do not agree with these Terms or any part thereof, then you may not access, use or engage with our Services.
PLEASE NOTE THAT:
1. BY ACCESSING, USING OR ENGAGING WITH OUR SERVICES, OR OTHERWISE SIGNIFYING YOUR AGREEMENT TO THESE TERMS, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO ALL TERMS AND CONDITIONS SET OUT HEREIN; AND
2. AS SET OUT ABOVE, IF YOU DO NOT AGREE WITH THESE TERMS OR ANY PART THEREOF, THEN YOU MAY NOT ACCESS, USE OR ENGAGE WITH OUR SERVICES.

Platform 09 grants you a revocable, non-exclusive, non-transferable, limited license access, use and engage with the Services strictly in accordance with these Terms and the functionality of the Services. If you violate any of these Terms, we reserve the right to cancel the foregoing licence, cancel or block access to your account or otherwise block or restrict your access, use or engagement with the Services, without notice.
Key terms used under these Terms are defined as set out in the Privacy and Cookie Policy for the Services.
Other Terms and Policies
In addition to the Terms, you also accept and agree to the terms and conditions of the Privacy and Cookie Policy[the Ticketing Terms, the Event Attendance Rules] and the Covid-19 Policy (“Other Terms and Policies”) in respect of the Services and Event.
Your account
You may register an account on the Services, and will be required to if you wish to purchase Event tickets. You will not register an account or purchase tickets if your account has previously been cancelled, withdrawn or suspended.
You are responsible for: (1) keeping your account username and password secure and confidential; (2) preventing unauthorised or unlawful access to your account; and (3) any and all activities that occur on your account, whether or not such activities were conducted by you or on your behalf. If you have any reason to believe that the confidentiality or security of your username and / or password has been compromised, or your account has been, or is likely to be, accessed in an unauthorised or unlawful way you must inform us immediately.
You warrant that any details, information or other data of whatsoever nature provided in relation to the account is true, accurate and correct. You will immediately update and correct your account if any of this data changes.
Restrictions
You agree not to, and you will not permit others to:
● License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Services or make the Services available to any third party.
● Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Services.
● Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Platform 09 or its affiliates, partners, suppliers or the licensors of the Services.
Links to Other Websites
The Services may contain links to other websites not operated or controlled by Platform 09. We are not responsible for your data privacy in relation to such websites, nor the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. You acknowledge and agree that when you use a link to go from the Services to another website we have no obligation or liability in relation thereto, your browsing and interaction on any other website, including those that have a link on our Services, is subject to that website’s own rules and policies. Third party owners of such websites may use their own cookies or other methods to collect information about you.
Stopping the Services and changes to our terms & conditions
Platform 09 reserves the right to modify, suspend or discontinue, temporarily or permanently (“Stop”) providing, the Services or any part thereof, with or without notice and without liability to you. You acknowledge and agree that Platform 09 may Stop providing the Services (or any features within the Services) to you or to users generally at Platform 09’s sole discretion, without prior notice to you. Platform 09 has no liability to you for any claims, costs, expenses, liabilities, damages and suits (of whatever nature and whether occurring now or in the past or future) either directly or indirectly connected to Platform 9 Stopping the Services, You may stop using the Services at any time at your sole cost and expense. You acknowledge and agree that if Platform 09 Stops the Services, you may be prevented from accessing the Services, your account details or any files or other materials which are contained in your account. Platform 09 may delete such details, files or other materials without liability to you.
From time to time we may change our Services and these Terms. Where required by law, we will notify you (for example, through our Services) of the changes before we make them. Changes become effective when the new Terms are posted on the Services, and you agree to check these Terms regularly to keep yourself informed of any changes made.
If we Stop the Services these Terms shall by their very nature continue to apply.
Updates to our Services
Platform 09 may from time to time provide enhancements or improvements to the features/ functionality of the Services, which may include patches, bug fixes, updates, upgrades and other modifications (“Updates”).
Updates may modify or delete certain features and/or functionalities of the Services. You agree that Platform 09 has no obligation to (i) provide any Updates, (ii) continue to provide or enable any particular features and/or functionalities of the Services to you, or (iii) continue to host or hold any of your details, files or other materials on the Services.
You further agree that all Updates will be (i) deemed to constitute an integral part of the Services, and (ii) subject to these Terms.
Third-Party Services
We may display, include or make available as part of or via the Services third-party content (including data, information, applications and other products services) or services (“Third- Party Services”). You acknowledge and agree that Platform 09 shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Platform 09 does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.
Third-Party Services are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.
Indemnification
You agree to indemnify and hold Platform 09 and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the Services; (b) violation of these Terms or any law or regulation; or (c) violation of any right of a third party.
No Warranties
The Services are provided to you “AS IS”, “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Platform 09, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Services, including all implied warranties of merchantability, fitness for a particular purpose, title and
non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Platform 09 provides no warranty or undertaking, and makes no representation of any kind that the Services will meet your requirements, achieve any intended results, be compatible or work with any other software, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, to the maximum extent permitted under applicable law, neither Platform 09, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the website, or the information, content, and materials or products included thereon; (ii) as to the accuracy, reliability, or currency of any information or content provided through the website; or (iii) that the Services, its servers, the content, e-mails or other communications sent from or on behalf of Platform 09 are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Platform 09 or its affiliates and its and their respective licensors and service providers be liable to you for anything directly or indirectly related to your use of the Services including, without limitation, for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Services, third-party software and/or third-party hardware used with the Services, or otherwise in connection with any provision of these Terms), even if Platform 09 or its affiliates and its and their respective licensors and service providers have been advised of the possibility of such damages.
Notwithstanding the foregoing, to the maximum extent permitted by applicable law, you agree that the entire liability of Platform 09 and its affiliates and its and their respective licensors and service providers in relation to the Services and these Terms and your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by you for the Services.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
The failure by Platform 09 to exercise a right or to require performance of an obligation under these Terms shall not effect Platform 09’s ability to exercise such right or require such performance at any time thereafter nor shall waive any breach or constitute a waiver of any subsequent breach. No single or partial exercise of any right or power by Platform 09 under this Agreement shall preclude further exercise of that or any other right granted to Platform 09 herein.
Entire Agreement
These Terms and the Other Terms and Policies constitutes the entire agreement between you and Platform 09 regarding the Services and the Event and supersedes all prior and contemporaneous written or oral agreements between you and Platform 09.
Intellectual Property
We own all the intellectual property rights (including, without limitation, copyright, trademarks, design rights, and patents, whether registered or un-registered) and materials contained in the Services, and we reserved all such rights. Nothing in these Terms grants you a right or licence to use any intellectual property rights owned or controlled by us or any other third party except as expressly provided in the Terms. The Services and material on the Services may not be copied, modified, reproduced, republished, sold, rented, sub-licenced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of Platform 09
Submissions
In the event that you submit or post to the Services any ideas, creative suggestions, designs, photographs, videos, audio, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions (“Your Materials”), you expressly agree that Your Materials will automatically be treated as non-confidential and non-proprietary and will become the sole property of Platform 09 without any compensation or credit to you whatsoever. Platform 09 and its affiliates shall have no obligations with respect to Your Materials and may use the ideas contained in Your Materials for any purposes in any medium in perpetuity, including, but not limited to, developing, manufacturing, and marketing products and services using such ideas. You undertake and agree that Your Materials will comply with the law, the requirements of government bodies and public morals, and will not infringe any third party legal rights. We reserve the right to edit or remove Your Materials.
Promotions
Platform 09 may, from time to time, include contests, promotions, sweepstakes, or other activities (“Promotions”) that require you to submit material or information concerning yourself. Please note that all Promotions may be governed by separate rules that may contain certain eligibility requirements, such as restrictions as to age and geographic location. You are responsible to read all Promotions rules to determine whether or not you are eligible to participate. If you enter any Promotion, you agree to abide by and to comply with all Promotions rules.
Typographical Errors
In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and you have been charged. If you have already been charged for the purchase and your order is canceled, we shall immediately issue a credit / refund to you.
Territory of use
The Services are not intended for access, use or engagement by any person or entity in any jurisdiction or country where such access, use or engagement would be contrary to law or regulation.

Governing Law
These Terms are governed by the laws of Fujairah and the United Arab Emirates as applied in Fujairah. You consent to the exclusive jurisdiction of the UAE Courts in Fujairah in connection with any action or dispute arising between us and you under or in connection with these Terms.
